On the one hand, LÍNEA GRÁFICA, E.C.E. S.L., on the other hand, THE CLIENT (hereinafter "THE CLIENT"), agree to the following terms of this service contract:
LÍNEA GRÁFICA, E.C.E. S.L. reserves the right to accept any request for services from THE CUSTOMER. It will be understood that an order has been accepted when THE CUSTOMER fills out and submits the purchase request from our website or when a correctly completed and signed quote acceptance is made. LÍNEA GRÁFICA, E.C.E. S.L. undertakes to explain to THE CUSTOMER in writing the reasons for non-acceptance of an order by telephone, email or post. Under R.D. 1906/1999, which regulates distance contracting by telephone, electronic or telematic means, this contract is valid and is understood to be signed by THE CUSTOMER when contracting hosting services.
The acceptance of these TERMS and CONDITIONS shall imply the formalization of the contract between THE CLIENT and LÍNEA GRÁFICA, E.C.E. S.L., which shall be effective as of the date of acceptance of this document.
The purpose of this contract is the provision of hosting services or Internet hosting of web pages, web design and development, SAS software, among others. The types of services rendered are classified within the following categories:
Multidomain web hosting
Dedicated servers
Virtual servers
Reseller plans
Software subscription service
Web design and development: web pages, blogs, virtual stores, etc.
Prestashop modules for sale
SMS Sending Service Platform
Additional complements related to the above services
LÍNEA GRÁFICA, E.C.E. S.L. will provide THE CLIENT, upon contracting, the following services:
The hosting will be located on servers permanently connected to the Internet network.
However, LÍNEA GRÁFICA, E.C.E. S.L. cannot guarantee that the availability of the service will be continuous and uninterrupted during the term of the contract, due to the possibility of problems in the Internet network, server equipment failures and other possible unforeseeable contingencies.
Likewise, if the domain shares the same machine with other domains, technical problems attributable to third parties may occur, for which LÍNEA GRÁFICA, E.C.E. S.L. shall not be held responsible.
Therefore, the CLIENT expressly waives the right to claim any liability, contractual or extra- contractual, damages from LÍNEA GRÁFICA, E.C.E. S.L. for possible failures, slowness or errors in the access and use of the contracted service.
LÍNEA GRÁFICA, E.C.E. S.L. will provide primary and secondary name servers for THE CLIENT, being LÍNEA GRÁFICA, E.C.E. S.L. in charge of the work necessary for the proper execution of operations and access to them at all times.
LÍNEA GRÁFICA, E.C.E. S.L. performs complete backups of all Shared Hosting servers on a regular basis, which may be weekly, biweekly or monthly as it deems appropriate. LÍNEA GRÁFICA, E.C.E. S.L. will do everything possible to help the CLIENT in case of data loss. LÍNEA GRÁFICA, E.C.E. S.L. will make every effort to ensure its backups in good faith.
LINEAGRAFICA, E.C.E. S.L. has NO OBLIGATION to back up any dedicated server or cloud server. The responsibility for making such backups rests entirely with the CUSTOMER.
The CUSTOMER has tools to manage its backups for which it is fully responsible.
LÍNEA GRÁFICA, E.C.E. S.L. shall not be liable for the accidental loss of information that may occur for any reason beyond the control of LÍNEA GRÁFICA, E.C.E. S.L.. Likewise, neither can it be guaranteed that in the process of recovering information from backup copies they can be restored correctly.
LÍNEA GRÁFICA, E.C.E. S.L. shall provide THE CLIENT from the date of contracting the service all necessary support and timely technical assistance for the development, expansion and improvement of its activities related to the domains hosted on the servers of LÍNEA GRÁFICA, E.C.E. S.L..
LÍNEA GRÁFICA, E.C.E. S.L., through its personnel and corresponding technicians, will offer the CLIENT, upon request, technical assistance on the aspects related to the contracted services, and cannot offer this assistance for issues related to the programming of applications in the following areas
design, database design and configuration, consulting, marketing and development of your web site in general terms.
In relation to the assistance and information regarding the scripts that have been created or produced by LÍNEA GRÁFICA, E.C.E. S.L., such technical assistance shall be based on providing the appropriate information about the installation. In any case, the modification or changes to the scripts, both in their pages and in their codes, are excepted.
In any case, and at the express request of the CLIENT, LÍNEA GRÁFICA, E.C.E. S.L. may transmit commercial and technical references of those CLIENTS or third party companies that can provide the above services and that are outside the scope of this contract.
LINEAGRAFICA E.C.E. S.L. reserves the right to configure the Shared Hosting Servers at its own discretion. These configurations may be changed without notice, either by legal obligation, updating versions of the services offered, security enhancements etc.. It will be the responsibility of the customer to adapt the scripts used in the Shared Hosting Servers in the event that the normal operation of these scripts would be affected by such changes. In any case, LINEAGRAFICA E.C.E. S.L. will try to notify by email to all users affected by such changes.
LINEAGRAFICA E.C.E. S.L. will deliver to the CUSTOMER the Dedicated Servers and / or Cloud Servers with the Operating System and configuration contracted by the CUSTOMER. The CUSTOMER may configure such servers as it deems appropriate, being the responsibility of LINEAGRAFICA E.C.E. S.L. to comply with the contracted hosting service. Any error arising from misuse, misconfiguration, malpractice or similar will be the sole responsibility of the customer, not having LINEAGRAFICA E.C.E.
S.L. any liability arising from such situation.
LÍNEA GRÁFICA, E.C.E. S.L. provides services to different clients, and has the responsibility to provide each client with the best possible services. The following rules have been established to ensure that these obligations can be fulfilled. THE CLIENT agrees to comply with these rules. Failure to comply with this clause by THE CLIENT shall result in the termination of this contract by LÍNEA GRÁFICA, E.C.E. S.L., without THE CLIENT having the right to claim any compensation.
THE CLIENT acknowledges being of legal age. Otherwise, the contracting carried out by minors requires the prior authorization of their parents, guardians or legal representatives, who will be considered responsible for the contracting carried out by the minors in their charge. It shall be the minors who must obtain the necessary consent to proceed with the contracting.
The authorization must be sent duly signed by the guardian by mail, fax or email to LÍNEA GRÁFICA,
E.C.E. S.L..
The maximum monthly transfer is defined in the features of the contracted plan. In the event that a domain consumes part of the system resources so that the performance of the rest of the plans hosted on the same server is significantly diminished (typically the case of multiple domains on the same IP, domains with files or galleries, eg .gif, .jpg, .exe, .tar, etc., and accounts that offer file downloads) LÍNEA GRÁFICA,
E.C.E. S.L. will temporarily disable the domain and will contact THE CUSTOMER to resolve the problem. This does not mean that the site cannot contain these files.
The activities that under no circumstances will be allowed in the servers and hosting services contracted through LÍNEA GRÁFICA, E.C.E. S.L. are the following:
"spamming" (any kind of sending of SPAM, sending of unsolicited electronic advertising communications to those with whom the CUSTOMER has no previous commercial relationship, or sending of "off-topic" advertising in newsgroups).
"spoofing" (using a reply-to e-mail address that is not the sender's valid reply-to address or sending an e-mail message that does not contain enough information to allow the recipient to identify the person who is actually sending the message)
"passive spamming" (promotion of a website hosted by LÍNEA GRÁFICA, E.C.E. S.L. by spamming from some other source).
"trolling" (sending controversial messages to newsgroups for the sole purpose of generating responses and disrupting the group's operation).
"mailbombing" (flooding a user with e-mail with no intention to correspond).
generate a higher amount of outgoing mail than the normal user, consuming part of the system resources so that the performance of the rest of the plans hosted on the same server is significantly reduced.
subscribing someone to an e-mail list without that person's permission.
A message is considered unsolicited if it is against the newsgroup charter or if it is sent to an unsolicited recipient. Putting an e-mail address to
available to the public does not constitute a solicitation to receive messages. The distribution of mass e- mailing programs is also prohibited.
All subscribers to a mailing list must have voluntarily and personally signed up. Mailing lists may not be used to distribute unsolicited messages. If the CLIENT repeatedly "mailbombs" or attracts such behavior, LÍNEA GRÁFICA, E.C.E. S.L. will interrupt its contract, without the CLIENT having the right to claim any compensation.
Unacceptable activities in this regard include:
Sending or publishing private information about a person without their prior consent. Infringement of intellectual property rights.
Defamation of a person or business.
Knowingly publishing code that will have harmful effects on third-party computers.
LÍNEA GRÁFICA, E.C.E. S.L. is in favor of freedom of expression on the Internet, and will not suspend or terminate THE CLIENT's account simply for agreeing or disagreeing with the views expressed by THE CLIENT. In the event that there are allegations about the alleged violation by THE CLIENT's online activity of the legal rights of a third party, LÍNEA GRÁFICA,
E.C.E. S.L. shall not be the judge as to the decision to be taken in relation to the claims of such third party.
The services of LÍNEA GRÁFICA, E.C.E. S.L. may only be used for lawful purposes. Illegal activities include, but are not limited to:
Drug trafficking.
Attempt to gain unauthorized access to a computer system.
Piracy (distribution of copyrighted material in violation of copyright laws, in particular files.
MP3, MPEG, ROMs and ROM emulators)
Betting.
Fraud and schemes to defraud.
Trafficking in obscene material.
sending obscene messages or messages with obscene, lewd, lascivious, lustful, filthy or indecent content with the intent to annoy, harass, threaten or stalk another person.
Threats of physical harm to other individuals or groups.
Harassment.
Violation of Spanish laws (as LÍNEA GRÁFICA, E.C.E. S.L. is Spanish and where LÍNEA GRÁFICA, E.C.E. S.L.'s servers are located).
Violation of the laws of the country in which the CLIENT carries out its activities.
Links to illegal materials.
LÍNEA GRÁFICA, E.C.E. S.L. reserves the right to check files contained in its servers for illegal materials and content, or for any other reasons it deems necessary.
Pornography and the marketing of products of a sexual nature, or links to such materials, will only be acceptable if their content is legal.
LÍNEA GRÁFICA, E.C.E. S.L. reserves the right to report illegal activities to the police or any administrative or governmental authority for prosecution.
It is not allowed to run non-permitted programs on the servers behind the back of LÍNEA GRÁFICA,
E.C.E. S.L. without prior written authorization. Additionally, the use of more than 20% of system resources is an undue overload on the server and is not acceptable. If the use of the system exceeds 20% of the total resources, THE CLIENT will be
contacted to solve the problem. In addition, if a domain or website exceeds 3 Gigabytes of monthly traffic, it may be cancelled without notice.
All shared hosting plans are limited and contracted by space and monthly traffic. However, it may be the case that the CUSTOMER account consumes much more server resources apache, mysql, RAM or disk activity to the point that begins to affect other users on the server. For this purpose LÍNEA GRÁFICA, E.C.E.
S.L. will measure the size of the apache log of the CLIENT's domains. If any domain exceeds the size of 50,000 bytes THE CUSTOMER will be forced to migrate to a Basic Cloud Server as a minimum.
You can ask the support department to indicate the log consumption of any domain at any time so that you can be aware of its consumption. In this way we ensure that the servers are not saturated and work optimally for all users who share it.
The following examples are not exclusive, and are given as a guideline for behavior. CUSTOMERS may contact LÍNEA GRÁFICA, E.C.E. S.L. if they are unsure whether their actions constitute a violation of our policy:
Sending messages of an intrusive nature to any network
Attempts to bypass user authentication or security measures of a server, network or account.
Access to data not directed to the user.
Security probing of any network.
Spawning of dozens of processes.
Port scanning, ping floods, packet spoofing, router information forgery, attacks.
"Denial of Service", "sniffers", "flooding", "spoofing", "ping bombing", "smurfs", "winnuke", "land", "teardrop".
Virus promulgation.
IRC robots such as eggdrop or BitchX.
Any activity, whether or not resulting in the intrusion in the corruption or loss of data, will be investigated and appropriate action will be taken. The presence of any of these programs, whether or not executed, will cause the action of LÍNEA GRÁFICA, E.C.E. S.L. against the CLIENT, including the suspension or termination of the contract, without the CLIENT having the right to claim any compensation.
The following services will be performed whenever possible, at the customer's request, as a security- enhancing measure
Updating of operating system versions and/or server services, at the client's request, so as not to interfere with the hosted applications.
Kernel and Directadmin updates, upon customer request or system needs.
24/7 monitoring of the server.
Any migration to a superior product, subject to a feasibility study, can be done under budget.
In case THE CUSTOMER wishes to change to an inferior product, THE CUSTOMER i s responsible for migrating his/her data.
The installation of software or hardware not directly related to the operating system or control p a n e l . Any additional software installation will be budgeted ENTE has accepted and paid the budget for the operation.
Solve programming problems of files, scripts or applications uploaded and used by the CUSTOMER or updates thereof.
Migrations from other suppliers to LÍNEA GRÁFICA, E.C.E. S.L.. The CLIENT is responsible for ensuring that the migration has been carried out successfully. At no time shall the administrators of LÍNEA GRÁFICA, E.C.E. S.L. be obliged to provide support for a migration or technical problem with a provider external to LÍNEA GRÁFICA, E.C.E. S.L..
The fee for interventions that are NOT included in the administration of the services offered will be 60€/hour, VAT not included, and may vary depending on the work or service to be performed.
THE CUSTOMER is solely responsible for updating its files, scripts and/or applications and do everything possible to ensure that they have the minimum possible execution permissions. THE CUSTOMER is responsible for any damage caused by attacks made to his server from his files, scripts or applications (apache, ftp, email, mysql, etc...).
LÍNEA GRÁFICA, E.C.E. S.L. is authorized to cut the contracted line in all those cases in which this is necessary to carry out any adjustment, modification or improvement, as well as to repair possible faults. LÍNEA GRÁFICA, E.C.E. S.L. will try, as far as possible, to notify the CLIENT via email before making any cuts.
EASY COOKIES RGDP is a SaaS app, which enables compliance with the Cookie Law in Shopify stores. The app complies with the RGDP, guaranteeing the privacy of the app users' data.
The app incorporates a feature to your Shopify store that blocks cookies from the user's web browser when accessing the store for the first time, showing a pop up message with a descriptive text of the adevertencia, being this modifiable and offers the options to accept, reject and select for which cookies, both own and third party wants to accept the consent of use, thus complying with the "Cookies Act" Law 34/2002 of July 11, 2002 on services of the information society and electronic commerce (LSSI).
EASY COOKIES RGDP is a SaaS app, a software whose support is hosted on the servers of LINEA GRÁFICA, which can be accessed via the Internet, once the customer purchase process is completed.
The conditions of use of this specific service are specified in these contracting conditions.
The fact of providing the contracted service to the customer does not imply assignment of intellectual property rights to the customer in relation to the application.
The software is provided on an "as is and as available" basis. It is not guaranteed that the functionalities of the The company is committed to providing a wide range of products and services to meet the customer's specific needs.
The application can be purchased directly from Shopify's app portal https://apps.shopify.com/popup-de-cookies?locale=es&st_source=autocomplete .
For installation you must follow the instructions provided by the portal itself.
Once you complete all the steps, the app will be installed in your online store and will be ready for use.
The prices of this app will be those published in the Shopify App Marketplace at the time of hiring (https://apps.shopify.com/popup-de- cookies?locale=en&st_source=autocomplete ). LÍNEA GRÁFICA reserves the right to change prices according to its own commercial policy, without prior notice, with the notice it deems appropriate. The customer may suspend or cancel its service if it does not agree with such modification.
The payment of the service will be made by monthly cycles due will be Shopify who performs all management of collections and billing on the app. The service is activated on the day of contracting. The billing cycle that covers the service lasts 30 days, having the possibility to enjoy 14 days for free as a trial.
The service has no permanence. The customer may unsubscribe from this service at any time, following the guidelines and conditions that Shopify has stipulated for all apps available in its App Marketplaces.
The customer declares to be aware of this condition, and declares to be responsible for all the consequences and damages that the non-payment of the service and the consequent suspension of the service may cause.
Charges are made directly by Shopify, so LÍNEA GRÁFICA cannot be held responsible for any incidence on charges or payments.
The customer has the right to cancel the purchase, within the legal period of 14 days, without having to claim or give any explanation in this regard or suffer any penalty.
As provided for in Law 3/2014, of 27 March, the client may not withdraw in the cases provided for in its Article 103, in the following paragraphs:
a) The provision of services, once the service has been fully performed, when the performance has begun, with the prior express consent of the consumer and user and with the acknowledgment by him that he is aware that, once the contract has been fully performed by the entrepreneur, he will have lost his right of withdrawal.
m) The supply of digital content that is not provided on a tangible medium when the performance has begun with the prior express consent of the consumer and user with the knowledge on his part that he consequently loses his right of withdrawal.
The right of withdrawal of this SaaS application ends at the moment it is downloaded, with access to it by the customer.
LÍNEA GRÁFICA has a technical support service for incidents offered by e-mail at appsupport@lineagrafica.es.
The service may be terminated for the general causes provided by law for the termination of contracts.
In addition to the suspension, cancellation and termination for non-payment by the client, LÍNEA GRÁFICA reserves the right to suspend, cancel or terminate the contract if inappropriate use is made of the tool that may bring discredit or any other harm to LINEA GRÁFICA.
Suspension, cancellation and termination shall not entitle customers who have incurred in the above actions to compensation or indemnification.
Customer may cancel or suspend their service by following Shopify's cancellation or suspension policies.
LÍNEA GRÁFICA is the sole owner of the Intellectual Property Rights over the application. No property rights are transferred other than the license to use it under the conditions of use and requirements set forth.

LÍNEA GRÁFICA reserves the right to make changes and modifications to these terms and conditions at any time and without prior notice, in order to adapt them to technical or commercial needs or for operational or service reasons.
Changes will not affect the billing cycle in which they take place. They will become effective and binding on the customer in the next billing cycle.
However, LÍNEA GRÁFICA may announce or give prior notice of changes to these terms and conditions 30 days in advance, announcing the date on which the new conditions will take effect.
If the customer does not agree with the modified terms and conditions, he/she may suspend or cancel the service, prior written notice to LÍNEA GRÁFICA. The suspension or cancellation shall take effect in the next billing cycle following the billing cycle of the communication.
If the customer does not communicate the cancellation or suspension of the service, it will be understood that he/she agrees with the new conditions and accepts them.
LÍNEA GRÁFICA limits itself to making the developed application available to the client, under appropriate conditions of use.
LÍNEA GRÁFICA shall not be responsible for the use made of it by the customer. The customer assumes full responsibility for the use thereof.
If the tool has a fault, incident or defect, the customer must inform LÍNEA GRÁFICA as soon as possible, and LÍNEA GRÁFICA will be responsible for correcting it as soon as possible.
LÍNEA GRÁFICA shall not be liable for suspension or interruption o f service in cases of force majeure, acts of God, negligence in the use of the tool by the client, or suspension of third party services required to provide the service, among others, without these causes being understood numerus clausus.
Nor will Shopify assume any liability if Shopify makes changes to the API that affect its operation; makes changes to the core stores that affect the APP; performs updates that affect the operation of the APP; or any other technical modifications or alterations that Shopify performs that affect the proper functioning of the APP.
It will be the sole responsibility of the client if the store is not correctly configured for the app to work correctly; if the client does not correctly configure the options offered by the app; if the client has made modifications to its template that may affect the correct operation of the app; if the client installs other apps that may conflict with the operation of the app; that the client uninstalls the app, or in any other case that, by actions of the client itself, or third parties that it has subcontracted, such as template or app developers or third parties that manage the maintenance of the systems, modifications or updates are made or any intervention that may affect the correct functioning of the app.
In case o f any incident or dispute with LINEA GRÁFICA that our customer service has not been able to solve, we inform you that you can resort to the ODR platform created by the European Commission, free and open access, on out-of-court settlement of disputes arising from online services. You only have to access this link: http://ec.europa.eu/odr.
The customer accepts the submission to the jurisdiction of the Courts and Tribunals of Seville for any actions and claims that may arise from this contract and in respect of which such submission is valid.
For matters not covered in this point, the rest of the general conditions published on our website shall apply.

The service has no permanence. The customer may unsubscribe from this service at any time, following the guidelines and conditions that Shopify has stipulated for all apps available in its App Marketplaces.
The customer declares to be aware of this condition, and declares to be responsible for all the consequences and damages that the non-payment of the service and the consequent suspension of the service may cause.
Collections are made directly by Shopify, so LÍNEA GRÁFICA cannot be held responsible for any incidence on collections or payments.
The customer has the right to withdraw from the purchase, within the legal period of 14 days, without having to claim or give any explanation in this regard or suffer any penalty.
As provided for in Law 3/2014, of 27 March, the client may not withdraw in the cases provided for in its Article 103, in the following paragraphs:
a) The provision of services, once the service has been fully performed, when the performance has begun, with the prior express consent of the consumer and user and with the acknowledgment by him that he is aware that, once the contract has been fully performed by the entrepreneur, he will have lost his right of withdrawal.
m) The supply of digital content that is not provided on a tangible medium when the performance has begun with the prior express consent of the consumer and user with the knowledge on his part that he consequently loses his right of withdrawal.
The right of withdrawal of this SaaS application ends at the moment it is downloaded, with access to it by the customer.

The service may be terminated for the general causes provided by law for the termination of contracts.
In addition to the suspension, cancellation and termination for non-payment by the client, LÍNEA GRÁFICA reserves the right to suspend, cancel or terminate the contract if inappropriate use is made of the tool that may bring discredit or any other harm to LINEA GRÁFICA.
Suspension, cancellation and termination shall not entitle customers who have incurred in the above actions to compensation or indemnification.
The customer can cancel or suspend their service by following Shopify's cancellation or suspension policies
LÍNEA GRÁFICA is the sole owner of the Intellectual Property Rights over the application. No property rights are transferred other than the license to use it under the conditions of use and requirements set forth.

If the customer does not agree with the modified terms and conditions, he/she may suspend or cancel the service, prior written notice to LÍNEA GRÁFICA. The suspension or cancellation shall take effect in the next billing cycle following the billing cycle of the communication.
If the customer does not communicate the cancellation or suspension of the service, it will be understood that he/she agrees with the new conditions and accepts them.

If the tool has a fault, incident or defect, the customer must inform LÍNEA GRÁFICA as soon as possible, and LÍNEA GRÁFICA will be responsible for correcting it as soon as possible.
LÍNEA GRÁFICA shall not be liable for suspension or interruption o f service in cases of force majeure, acts of God, negligence in the use of the tool by the client, or suspension of third party services required to provide the service, among others, without these causes being understood numerus clausus.
Nor will Shopify assume any liability if Shopify makes changes to the API that affect its operation; makes changes to the core stores that affect the APP; performs updates that affect the operation of the APP; or any other technical modifications or alterations that Shopify performs that affect the proper operation of the APP.
It shall be the sole responsibility of the client if the store is not correctly configured for the app to work properly; if the client does not correctly configure the options offered by the app; if the client has made modifications to its template that may affect the proper functioning of the app; if the client installs other apps that may conflict with the operation of the app; that the client uninstalls the app, or in any other case that, by actions of the client itself, or third parties that it has subcontracted, such as template or app developers or third parties that manage the maintenance of the systems, modifications or updates are made or any intervention that may affect the correct functioning of the app.

The customer accepts the submission to the jurisdiction of the Courts and Tribunals of Seville for any actions and claims that may arise from this contract and in respect of which such submission is valid.

It is a module to provide automatic support service with AI-based management and responses.
The objective of this module is to provide your WHMCS installation with an Artificial Intelligence (AI)
based help and ticket response system. This will be done using the latest stable version of OpenAI's GPT (currently gpt-4-1106-preview) with "Retrieval" and "Code interpreter" capabilities enabled. With this module, you will be able to create an IA wizard for each of the departments you have configured in your WHMCS installation. You will be able to configure a customized generic prompt for each of them, where specific indications will be given on how to interpret and respond in each case.
When a department's assistant is activated, it will automatically send OpenAI a query with each ticket that is opened to that department, obtaining a response from its assistant. This response will be proposed within the ticket when a user opens the ticket to answer it. You will be able to use this answer or modify it as you wish before answering the ticket.
Each attendant can be trained with customized files and with the department's own ticket history files. Thanks to this training and a well-written prompt, the attendant will provide highly qualified answers to the ticket.
You can also schedule calendars for each attendant, so that during stipulated days and times, attendants will automatically respond to customer tickets. The calendars can be configured to indicate which employee will respond, which statuses they will respond to, which statuses they will move responded tickets to, and add extra customizations to the prompts to let attendees know, for example, that they are on "on-call".

The software is provided on an "as is and as available" basis. It is not guaranteed that the functionalities of the module meet the specific needs of the customer.

1.- Select the Plan you wish to contract and click on "Order now". 2.- Once you access the shopping cart, you must click on "Buy".
3.- In the following section you will have to fill in all the requested data, check the required boxes, select payment method and click on complete order.
4.- Once these steps are completed and the payment is validated by LÍNEA GRÁFICA, your order will be processed and you will receive an e-mail with the order confirmation and instructions for its correct installation and configuration.
Prices will be those published in our online store at the time of contracting. LÍNEA GRÁFICA reserves the right to modify prices according to its own commercial policy, without prior notice, with the notice it deems appropriate. The customer may suspend or cancel their service if they do not agree with such modification.
Payment for the service will be made in monthly cycles and in advance. Once payment i s received and verified, our system will generate and send an invoice for the service and period. The service is activated on the day of contracting. The billing cycle that covers the service lasts 30 days.
The accepted means of payment are Bank Transfer, Bank Card, Paypal and any other means of payment that may be incorporated without prior notice. LÍNEA GRÁFICA reserves the right to add or delete payment methods without prior notice, offering the possibility of using alternative payment methods,
The service has no permanence. The customer may unsubscribe from this service at any time, always at least one month prior to the expiration date of each billing cycle. The cancellation of the service will be effective in the monthly billing cycle following the cancellation. The monthly billing cycle in which the cancellation of the service is processed will be charged in full, regardless of the day on which the cancellation takes place.
Prepayment is an essential and indispensable requirement for access to the service, so that the non- payment of the service will entitle LINEA GRÁFICA t o provisionally suspend access or terminate the contract. LINEA GRAFICA will inform the customer of the non-payment through the customer's contact email and, if within 10 days does not proceed to payment, may terminate the contract.
The customer declares to be aware of this condition, and declares to be responsible for all the consequences and damages that the non-payment of the service and the consequent suspension of the service may cause.
The customer has the right to withdraw from the purchase, within the legal period of 14 days, without having to claim or give any explanation in this regard or suffer any penalty.
As provided for in Law 3/2014, of 27 March, the client may not withdraw in the cases provided for in its Article 103, in the following paragraphs:
a) The provision of services, once the service has been fully performed, when the performance has begun, with the prior express consent of the consumer and user and with the acknowledgment by him that he is aware that, once the contract has been fully performed by the entrepreneur, he will have lost his right of withdrawal.
m) The supply of digital content that is not provided on a tangible medium when the performance has begun with the prior express consent of the consumer and user with the knowledge on his part that he consequently loses his right of withdrawal.
The right of withdrawal of this SaaS application ends at the moment it is downloaded, with access to it by the customer.
LÍNEA GRÁFICA has a technical assistance service for incidents through the support ticket system, available in the customer area at clientes.lineagrafica.es.
The service may be terminated for the general causes provided by law for the termination of contracts.
In addition to the suspension, cancellation and termination for non-payment by the client, LÍNEA GRÁFICA reserves the right to suspend, cancel or terminate the contract if inappropriate use is made of the tool that may bring discredit or any other harm to LINEA GRÁFICA.
Suspension, cancellation and termination shall not entitle customers who have incurred in the above actions to compensation or indemnification.
The customer may cancel or suspend service with a minimum of 1 day's written notice prior to the current billing cycle.
LÍNEA GRÁFICA is the sole owner of the Intellectual Property Rights over the application. No property rights are transferred other than the license to use it under the conditions of use and requirements set forth.

LÍNEA GRÁFICA reserves the right to make changes and modifications to these terms and conditions at any time and without prior notice, in order to adapt them to technical or commercial needs or for operational or service reasons.
Changes will not affect the billing cycle in which they take place. They will become effective and binding on the customer in the next billing cycle.
However, LÍNEA GRÁFICA may announce or give prior notice of changes to these terms and conditions 30 days in advance, announcing the date on which the new conditions will take effect.
If the customer does not agree with the modified terms and conditions, he/she may suspend or cancel the service, prior written notice to LÍNEA GRÁFICA. The suspension or cancellation shall take effect in the next billing cycle following the billing cycle of the communication.
If the customer does not communicate the cancellation or suspension of the service, it will be understood that he/she agrees with the new conditions and accepts them.

Open AI also assumes no liability if Open AI makes changes to the API that affect its operation; if it makes changes to the core of its operation that affect the module; performs
updates that affect the correct operation of the module or any other technical modification or alteration that WHMCS or OPEN AI carries out and affects the correct operation of the module.
It will be the sole responsibility of the customer if the WHMCS is not correctly configured for the correct operation of the module; if the customer does not correctly configure the options offered by the module; if the customer has made changes in its WHMCS that may affect the correct operation of the MODULE; if the customer installs other modules that may conflict with the operation of the module in question; that the client uninstalls the module, or in any other case that, by actions of the client himself, or third parties that he has subcontracted, such as third party developers who manage the maintenance of the systems, modifications or updates are made or any intervention that may affect the correct operation of the module.
The handling of this module involves the use of AI technology to generate qualified responses to customer tickets, for which the customer is expressly advised and declares to be aware of the following warnings and precautions:
The answers provided by the assistants will depend largely on the quality of the training received and the prompt with which they work. The training and the way it is done is the responsibility of the client, following the instructions provided by LINEA GRÁFICA with its acquisition.
Under no circumstances and in any situation LINEA GRAFICA, as the company developing the module, will be responsible for the answers generated by the attendees or those situations in which no response is generated, regardless of the cause. Nor will it be responsible for any damages that may cause such responses or omissions of response since the answers or omissions will depend on the training done by the customer.
Nor will it be responsible for the use that the customer makes of the module.
LINEA GRÁFICA disclaims any incidence or failure, damage or liability arising from the use of the OpenAI API. The work is developed using, among other technologies, the OpenAI API. This API can sometimes be overloaded and take a long time to respond, or even fail temporarily. Such situations are entirely beyond LG's control and under no circumstances shall LG be liable for such situations and any damages that may be caused by such malfunction.
Both the wizards created and the training files used in a wizard can be viewed and managed from the customer's OpenAI account. We recommend training from the module, but it is also possible to train a wizard independently from the OpenAI account. It is essential to create the wizard from the module to link it to a department.
In case of any incident or conflict with LINEA GRÁFICA that our customer service has not been able to solve, we inform you that you can resort to the ODR platform.

Once paid, the domain is registered for the time requested, normally one year. After this period the domain must be renewed in advance so that it does not expire. A domain is considered paid in the following cases:
Payment by credit card: from the moment that LINEAGRAFICA E.C.E. S.L. has a record in the bank authorized for payment by credit card. The verification process will normally be automatic and on the spot. In case of error by the bank LINEAGRAFICA E.C.E. S.L. declines any responsibility and will be governed by the conditions of payment by transfer.
Payment by bank transfer: from the moment LINEA GRAFICA E.C.E. S.L. is registered in the bank authorized for payment by bank transfer. The verification process can take up to 1 week.
Payment by Paypal: from the moment that LINEAGRAFICA E.C.E. S.L. has a record in the Paypal account enabled for this purpose. The verification process will normally be automatic and on the spot. In case of error by Paypal LINEAGRAFICA E.C.E. S.L. declines any responsibility and will be governed by the conditions of payment by transfer.
In any case, they will not be attributable to LINEAGRAFICA E.C.E. S.L. errors in the registry of the domain by causes foreign to the service that provides. As an example some of the most common errors when registering and / or renew a domain are listed below:

Only the following names can be registered as domain names: Names that are available. A name is available when:
It is not registered as a Domain Name.
It is not reserved, blocked or has been notified to the Registry as "non-registrable" in accordance with the following conditions
with the General Policy Rules, unless otherwise stipulated therein.
It has not been requested during the Staggered Registration Period.
Names that meet the following technical requirements:
A minimum of 2 characters selected from the letters "a" through "z" in standard Latin script, the digits "0" through "9" and the hyphen ("-").
A maximum of 63 characters (not including the ".eu" suffix).
Do not begin or end with a hyphen ("-").
Not containing a hyphen ("-") in the third and fourth positions.

During the term, THE CLIENT assumes the following obligations: Maintain accurate, complete and updated contact information referred to in point 12 of this contract, with LÍNEA GRÁFICA, E.C.E. S.L. with whom THE CLIENT has entered into an agreement.
Furthermore, THE CLIENT declares and guarantees that any e-mail address communicated in the Registry is an active address.
Use the domain name in a manner that does not violate the rights of third parties, applicable laws or regulations, including discrimination on the basis of race, language, sex, religion or political opinions. Not to use the domain name in bad faith or for illicit purposes.
The CLIENT is obliged to notify LÍNEA GRÁFICA, E.C.E. S.L. if he/she detects that his/her domain has not been correctly registered.
For the purposes of the provisions of Articles 11 and 34.e) of the LOPD, THE CLIENT accepts and authorizes LÍNEA GRÁFICA, E.C.E. S.L. to communicate to the corresponding Registry Entities and ICANN, the mandatory data required for the registration and maintenance of the domain name in the relevant registry, and for them to be included in the Directories managed by each of them, as well as for such data to be included in LÍNEA GRÁFICA, E.C.E. S.L.'s own Directory and made available to the public through the "Whois" system.
THE CLIENT consents, and if applicable, whoever acts on their behalf as technical, administrative and/or billing contact, that their personal data may be transferred to the aforementioned entities and those others participating in the registration process, which may collaborate with LÍNEA GRÁFICA, E.C.E.
S.L. and/or with such entities.
THE CLIENT affirms to have the consent of the persons designated as technical, administrative and/or billing contacts for the purposes of the provisions of the preceding paragraph.
To this end, we inform you that the data and information of the Applicant and/or its representatives, if any, will be transmitted to the Registration Entities and will be included in the directories available to the public, and will deal with the following matters:
Applicant's full name, address, e-mail address, telephone number and, if applicable, fax numbers. Name of an authorized contact person if the CUSTOMER is a legal entity or administrative body, and, if applicable, of the contact person responsible for administrative and/or billing tasks.
IP addresses of the primary server and secondary servers.
Any additional reference to the domain name that should appear in the Whois database.
Currently LÍNEA GRÁFICA, E.C.E. S.L. does not offer the possibility of protecting the personal data that appears in a Whois to a domain.
The final expiration date to renew the domain will be just the day before the registration date, since on the same day of expiration the domain would already be expired. Whatever the renewal date is, that date will always be the same as the initial registration date.
LÍNEA GRÁFICA, E.C.E. S.L. has an automated system through which THE CLIENT will receive several reminders by email before the domain renewal date:
First reminder 30 days before the domain payment due date.
Second reminder 15 days before the domain payment due date.
Third reminder 7 days before the domain payment due date. In this reminder, you will be notified of the creation of the payment slip so that you can renew the domain name.
Not receiving a reminder about the renewal of a domain is not a reason to make any claim. The CLIENT has the option of not renewing the domain, by canceling it without any additional cost or simply letting it expire by itself. The CLIENT is fully responsible for the renewal or expiration of the domains contracted with LINEA GRAFICA, E.C.E. S.L.
Notifications and reminders will be sent to the data provided by the CLIENT by email. LÍNEA GRÁFICA, E.C.E. S.L. shall not be liable for non-receipt of these notifications. The CLIENT is responsible for notifying LÍNEA GRÁFICA, E.C.E. S.L. of any changes to the data.
When a domain is not renewed before the expiration date, it goes into "Expired" mode.
If the CLIENT wishes to renew a domain that is in "Expired" mode, he/she will have to pay the restoration fee imposed by the registrar to which the domain corresponds, as well as a 20€ administrative management fee (VAT not included). The restoration fee does not include the domain renewal, nor does it include the cost imposed by the corresponding registrar for renewing a domain in this status. A restoration can take between 24h and 48h to be completed. Restoration fees vary depending on the registrar and can range from 0€ to 400€.
We cannot guarantee the renewal of a domain that has already expired, since it depends on the regulations of each TLD that possibility and the limit of days, if any, to do so.
THE CLIENT will be entitled to transfer a domain name when the following conditions are fully met:
The transferee has confirmed that it meets the General Eligibility Criteria; and
the Registry has received all the fees corresponding to such transfer through the Registrar appointed by the transferee.
A domain name that has been suspended or blocked may not be transferred except: (a) by a decision taken by a Panel in an Alternative Dispute Resolution Procedure, or (b) by a court of a member state; or
after receipt by the Registry of the relevant fees in this r e s p e c t , in case the Domain Name has been suspended in accordance with section 9.
A domain name may be transferred during the Term to the legal heirs of the Registrant (upon death) or to the purchaser of the Registrant's assets.
Upon transfer of a Domain Name in accordance with the above provisions, the Domain Name shall be registered in the name of the transferee for a new Term of one year, commencing on the date of the transfer of the Domain Name.
Upon completion of the transfer of a domain and for reasons beyond the control of LÍNEA GRÁFICA, E.C.E. S.L., or any incidents occurring during the transfer, it is the responsibility of the CLIENT to check the contact details attached to the domain and that they are correct. If this is not the case, he/she should contact our Domain Department to request the modification of the data.
A domain transfer can take a minimum of 5 business days from the time the CUSTOMER confirms the transfer.
Conditions of the domain to be transferred:
Once the domain transfer is completed, the LÍNEA GRÁFICA Domain Department,
E.C.E. S.L. will send an email to the CUSTOMER notifying him/her about it. The CLIENT must update the DNS of the domain to be directed to LÍNEA GRÁFICA, E.C.E. S.L..
The conditions are the same as the domain transfers mentioned in paragraph 6.10.1 above, except that the auth code is provided directly at NIC.es.
To transfer a .es domain THE CUSTOMER must accept the request from nic.es (the main entity of the
.es).
When you initiate a transfer from LÍNEA GRÁFICA, E.C.E. S.L., nic.es will send you an email with instructions. In most cases, we do not know this information.
The .es transfers have a management cost of 5€ vat not included and the domain is not renewed automatically. You must renew the domain before its expiration date. If the domain expires in a short period of time, we recommend that you renew before with the company where the domain is registered to avoid problems in case the transfer takes longer than expected to be completed. LÍNEA GRÁFICA, E.C.E.
S.L. is not responsible if the domain expires due to not renewing it on time.
Once the domain transfer is completed, the LÍNEA GRÁFICA Domain Department,
E.C.E. S.L. will send an email to the CUSTOMER notifying him/her about it. The CLIENT must update the DNS of the domain to be directed to LÍNEA GRÁFICA, E.C.E. S.L..
The CLIENT can modify the contact information of the domain at any time. To do so, simply go to the Client Area of LÍNEA GRÁFICA, E.C.E. S.L., click on "My domains", "Details", "Contact information", modify and save.
LÍNEA GRÁFICA, E.C.E. S.L. shall not be held responsible for failures that may occur in the domain registration system nor for the consequences that may arise as a result of these failures.
In cases where THE CUSTOMER has paid for a domain name and due to communication problems between LÍNEA GRÁFICA, E.C.E. S.L. and its domain provider, the domain has not been correctly registered, the domain will be unregistered.
LÍNEA GRÁFICA, E.C.E. S.L. is not responsible for damages caused if after a failure in the registration system the domain is registered by another domain provider. The CLIENT is obliged to confirm the registration of your domain in a WHOIS.
The CLIENT is obliged to notify LÍNEA GRÁFICA, E.C.E. S.L. if it detects that its domain has not been registered correctly. LÍNEA GRÁFICA, E.C.E. S.L. will make every effort in good faith to attempt to re-register the domain in case of failure, but does not guarantee that the domain will be free once it is attempted. The secondary registration attempt will be considered a new registration, unrelated to the failure that occurred the first time and must be treated as a new registration with all its consequences.
When the CUSTOMER places an order, the date of that moment is recorded, this will be the date that the system will use to make the appropriate service renewals.
If the CUSTOMER pays after the day of the order, he/she must take into account that this date will not be modified. In other words, the renewal date is NOT the day of payment but the day of the initial order.
THE CUSTOMER has a satisfaction period of 15 days from the time the order is placed. If the CUSTOMER is not satisfied with our service, LÍNEA GRÁFICA, E.C.E. S.L. undertakes to refund the full amount paid.
This guarantee does not include commission expenses according to the payment method, domain name registration if any or any other expense derived from the purchase.
In the event that the service purchased with LÍNEA GRÁFICA, E.C.E. S.L. does not comply with the points of this contract, NO refund will be made, even if it is within the trial period.
The satisfaction guarantee does not apply to those products or services that have been previously tested free of charge during the trial period.
There are products or services that do not have a satisfaction guarantee, the specific list is detailed in point
10.3 of this contract.
LÍNEA GRÁFICA, E.C.E. S.L. offers the possibility to try a series of products for free, categorized as "Free Offers". These products are displayed on the website and each one contains its own offer.
The trial period will be extended for the period of time specified in each offer from the time the order is placed.
These offers cannot be accumulated for the same product, only one offer is allowed for each product offered.
Once the offer is completed, the product will not have a satisfaction guarantee, since it is understood that the period offered gives a prudent and sufficient margin to test the product.
Due to the international system of domain name registration, domain names cannot be cancelled. Once registered or renewed, they are kept for one year, or as long as requested. We cannot accept returns.
It is also for this reason that if any payment is returned and LÍNEA GRÁFICA, E.C.E. S.L. does not receive the payment, the domain will automatically become the property of LÍNEA GRÁFICA, E.C.E. S.L.. If any payment fraud is detected, the domain will also become the property of LÍNEA GRÁFICA, E.C.E. S.L., and legal proceedings will be initiated against the fraudster.
Some products have a satisfaction guarantee period of 15 days (see point 11) and other products have a free trial period. If after that period there is any claim by THE CUSTOMER, LÍNEA GRÁFICA, E.C.E.
S.L. will offer THE CUSTOMER a solution that satisfies him/her.
by mutual agreement. In that case we will only accept Hosting cancellations that are attributable to problems in our service.

If the conditions for returning a product or service are met, LÍNEA GRÁFICA,
E.C.E. S.L. will refund the corresponding amount in the same way THE CUSTOMER made the payment. If THE CUSTOMER requests it, the money can be refunded as a credit in its favor to make new purchases.
LÍNEA GRÁFICA, E.C.E. S.L. will not make refunds by bank transfer to banks outside Spain, unless THE CLIENT takes full responsibility for the commissions involved.
LÍNEA GRÁFICA, E.C.E. S.L. will refund the money within a period of 1 to 30 days from the date of the return invoice.
The My Backup service is a service that consists of the installation and license of a backup management software called JetBackup, which is installed in the client's hosting panel, and a storage space in two datacenters in different countries each. The size of the space will depend on the plan in force at the moment of the client's contracting.
The price of the service is divided into registration + plan to be contracted, being the contracting and registration prices those that are published and in force at the time of contracting.
The My Backup service consists of offering the client a backup control and management tool as well as an available space in two different datacenters. Therefore, it will be the customer's responsibility to have scheduled and configured backups in these spaces, as well as the proper use of the tool and its possible configurations that allow data recovery.
Likewise, LÍNEA GRÁFICA, E.C.E. S.L. is not responsible for the use of the tool and the programmed configurations that the client may make.
The CUSTOMER may cancel the service or services contracted. The cancellation must be requested from the Client Area, and must be done for each service. Once sent, the administration department will check that everything is in order and will proceed to the termination of the requested service.
Such cancellation implies the deletion of all data stored in the space contracted by the CLIENT.
In the event that the CUSTOMER requests cancellation before the end of the contracted period, he/she will not have the right to claim the money corresponding to the time he/she has not used the service or product.
The required data, entered when registering as a client, must contain truthful and updated information about THE CLIENT. LÍNEA GRÁFICA, E.C.E. S.L. reserves the right to verify that the data is true, otherwise THE CLIENT will be required to provide us with the correct data immediately.
Any anomaly derived from the CLIENT's data not being correct will not be the responsibility of LÍNEA GRÁFICA, E.C.E. S.L..
Any change or modification of the registered address, financial data, account data, etc., must be updated by accessing from the client area to the section of MY DATA, for its rectification in our database.
An account can be changed at any time. To do so, the CLIENT must request it to the Administration Department and fill in the application form that will be sent to him/her. This application must be filled in and signed by the current account holder and by the new account holder, together with the identification documentation mentioned in the application itself (ID card or passport in the case of individuals or individuals; CIF and ID card of the administrator in the case of companies).
The first change of ownership is completely free of charge, the remaining changes will cost 15€ (VAT not included).

Once the new owner is registered as a client and the request is received, LÍNEA GRÁFICA, E.C.E. S.L. will transfer those products or services that have been requested for the change of owner. In this way, the new owner will have the services in its account and the old owner will have an empty account, simply with the invoices that had been issued up to that time.
From that moment on, the new owner will be the full administrator of the products or services assigned by the former owner.
The steps to be followed will be the same as those mentioned in the previous section (12.1.) except that the new owner will not have to register as a new customer since he/she is already a customer.
The CLIENT guarantees that he/she is the owner of the information stored by him/her in the servers of LÍNEA GRÁFICA, E.C.E. S.L. or that, in any case, he/she has the corresponding authorization to disclose such information through the Internet.
In order to guarantee the purposes of this contract, THE CLIENT authorizes LÍNEA GRÁFICA,
E.C.E. S.L. to make a backup copy of the information stored by the CLIENT in the servers of LÍNEA GRÁFICA, E.C.E. S.L. during the term of this contract.
THE CUSTOMER is solely responsible for the content broadcasted from our Hosting servers and Radio station servers. THE CUSTOMER must ensure that it complies with all the rules and requirements imposed by the SGAE to be able to broadcast music from its radio station.
THE CLIENT needs to have a license from the Sociedad General de Autores y Editores to be able to reproduce, store or use music in his web page, radio station or contracted FTP space. For more information visit the following link:

Access by LÍNEA GRÁFICA, E.C.E. S.L., to the data owned by THE CLIENT, shall not be considered communication of data, since as provided in art. 12.1 of the Organic Law 15/1999, said Responsible makes available to LÍNEA GRÁFICA, E.C.E. S.L., the file or files containing the data necessary for it to perform the services detailed in this Hosting Agreement.
It is hereby stated that the file or files made available to LÍNEA GRÁFICA, E.C.E. by THE CLIENT.
S.L. are duly legalized and legitimized, in compliance with the security measures provided for in art. 9 of the
L.O. 15/1999, of December 13 and adopt those to be determined by regulation.
Access by LÍNEA GRÁFICA, E.C.E. S.L. to the personal data contained in the files owned by THE CLIENT shall be carried out solely and exclusively for the purpose of allowing THE CLIENT to provide the services mentioned in this contract and shall process them in accordance with THE CLIENT's instructions, without being able to apply or use them for any other purpose.
In the event that LÍNEA GRÁFICA, E.C.E. S.L., uses the data for another purpose, communicates them or uses them in breach of the provisions of this contract, it will also be considered responsible for the file, and will be liable for any infractions it may have incurred.
LÍNEA GRÁFICA, E.C.E. S.L., in accordance with the provisions of art. 10 of the Organic Law 15/1999, is obliged to maintain, indefinitely, professional secrecy with respect to the personal data whose access is regulated by this contract; it is obliged not to communicate them, not even for their conservation to third parties, except i n the event that this is necessary to comply with the obligations arising from the provision of the Services or those imposed by law or mandatory regulations.
Upon completion of the contract, the personal data must be destroyed or returned to the CUSTOMER or the new service provider designated by the CUSTOMER, as well as any support or documents containing any personal data subject to processing. The destruction of data shall not proceed when there is a legal provision that requires its preservation, also, it may keep the data, duly blocked, as long as liabilities may arise from the relationship between LÍNEA GRÁFICA, E.C.E. S.L. and the CLIENT. If, in order to provide the agreed services, LÍNEA GRÁFICA, E.C.E. S.L. should need to subcontract, in whole or in part, the service described in this contract, the CLIENT shall be informed in this same space. Likewise, the identity of the subcontracted company shall be communicated to the CLIENT, with the following information

In compliance with art. 12.2, paragraph 2 of the L.O. 15/1999, LÍNEA GRÁFICA, E.C.E. S.L. has implemented in accordance with the provisions of R.D. 1720/2007, the security measures of basic level, and adopt those determined by regulation, to ensure the security and integrity of personal data and avoid its alteration, loss, unauthorized access or treatment, given the state of technology, the nature of the data stored and the risks to which they are exposed, whether from human action or the physical or natural environment. In order to ensure compliance with the above, the CLIENT may require LÍNEA GRÁFICA, E.C.E. S.L., at any time, all supporting documentation of such compliance.
At the moment, the housing services have been outsourced to the companies OVH and Hetzner.
The CLIENT acknowledges that, by virtue of its contractual relationship with LÍNEA GRÁFICA,
E.C.E. S.L., it may have access to information and materials related to business plans, customer lists, technology or marketing strategies of great value to LÍNEA GRÁFICA, E.C.E. S.L. and that they should not fall into the hands of third parties.
The CLIENT agrees not to use this information for their own benefit or that of third parties not authorized by LÍNEA GRÁFICA, E.C.E. S.L..
The CLIENT also undertakes to take the necessary measures to ensure that this information does not fall into the hands of third parties.
The CLIENT also agrees to return or destroy these materials upon termination of its contractual relationship with LÍNEA GRÁFICA, E.C.E. S.L.. LÍNEA GRÁFICA, E.C.E. S.L. reserves the right to claim damages from the CLIENT in case of non-compliance.

LÍNEA GRÁFICA, E.C.E. S.L. reserves the right to change the characteristics and prices of each service, and shall notify THE CLIENT of such changes at least 10 days in advance, prior to the renewal of the contract.
THE CUSTOMER shall pay the stipulated price in advance by one of the following forms of payment: Direct d e b i t . Only for certain services such as: dedicated servers, virtual servers, web positioning; once the CLIENT has returned the signed Authorization Form.
Transfer or deposit to the account of LÍNEA GRÁFICA, E.C.E. S.L., which will be provided to THE CUSTOMER when placing the order.

The method of payment is chosen by the CUSTOMER at the time of filling out the purchase request. Payments will always be made in Euros.
Direct Debit
Direct debit is the automatic collection of bills directly into the CUSTOMER's bank account.
The account is debited from the 1st to the 10th of each month. International bank transfers
THE CUSTOMER may make payments by bank transfer from outside Spain. In this case THE CUSTOMER must take charge of any commission that this entails. Otherwise we would not consider the transfer valid and would have to pay the corresponding commission that was not paid initially.
The necessary data for sending this type of transfers shall be requested by THE CLIENT to the Administration Department.
LÍNEA GRÁFICA, E.C.E. S.L. may apply a price increase depending on the payment method selected by the customer. This increase will always be informed before payment is made and will be reflected in the invoice.
LÍNEA GRÁFICA, E.C.E. S.L., the service provider, is established in Spain and provides the service from the headquarters of said establishment. Therefore, the services provided electronically are taxed as follows:

LÍNEA GRÁFICA, E.C.E. S.L. DOES have to charge VAT at the general rate of 21 percent (Article 70.2 of Law 37/1992, Article 9.3 of the Sixth Directive).
b-IV) A BUSINESSMAN OR PROFESSIONAL established in the Canary Islands, Ceuta or Melilla:
The place of performance is NEVER the Spanish territory of application of the tax. The operation will be taxed in the territory of the recipient (Canary Islands, Ceuta or Melilla, which are not VAT territories).
LÍNEA GRÁFICA, E.C.E. S.L. will NOT charge VAT.
b-V) AN INDIVIDUAL (not a businessman or professional) established or domiciled in Spain (Peninsula and Balearic Islands) or in any other State of the European Union:
The place of performance of these services is the Spanish territory where the tax is applicable (article 70.Uno.4° A) b) Law 37/1992).
LÍNEA GRÁFICA, E.C.E. S.L. will charge VAT to the recipient at the general VAT rate in Spain, 21 percent.
b-VI) AN INDIVIDUAL established outside the Community:
The place of performance of these services is the State of the recipient. LÍNEA GRÁFICA, E.C.E. S.L. will NOT charge VAT in any case.
LÍNEA GRÁFICA, E.C.E. S.L. processes its invoices in electronic format, which have the same legal validity as paper invoices. Our invoices comply with the rules stipulated in article 6 of RD 1496/2003.
Initially, delivery notes are created and once they are paid, they are transformed into official invoices. The system generates a delivery note for each purchase made. LÍNEA GRÁFICA, E.C.E. S.L. does not have the option of grouping several payments in a single invoice, unless several services have the same date of request or renewal.
THE CUSTOMER can pay the delivery notes by accessing from the Customer Area to the section of DELIVERIES / INVOICES. In this section there is a history of all invoices, which are downloadable and printable.
LÍNEA GRÁFICA, E.C.E. S.L. will not send invoices to customers by mail unless THE CUSTOMER requests it for a specific and justified reason.
18.1. Billing to third parties
LÍNEA GRÁFICA, E.C.E. S.L. does not invoice third parties. Our company will invoice directly with the billing information that appears in THE CUSTOMER's account and the CUSTOMER will have to issue an invoice to a third party on its own, independently of us.
The CLIENT must pay in advance the total amount of their services or products. Until this requirement is not met, our services will not be provided.
If for any reason there are unpaid debts in the CLIENT's account, LÍNEA GRÁFICA, E.C.E. S.L. will notify the CLIENT of such negative credits, which must be settled within the period indicated. THE CUSTOMER may not cancel its services until the debt has been settled.
All delivery notes have their own due date. Invoices are created one week before the renewal date (due date) so that the CUSTOMER can pay it on t i m e .
In the case of domain renewals the renewal date cannot be exceeded, if the domain is paid one day later the domain will have expired.
Once the expiration date has passed, the system will automatically suspend THE CUSTOMER's product. To reactivate it again, THE CUSTOMER will have to make sure that the product still exists and has not been deleted in its entirety, by contacting the commercial department of LÍNEA GRÁFICA, E.C.E.
S.L. for further information.
LÍNEA GRÁFICA, E.C.E. S.L. reserves the full right to completely delete the CLIENT's account after the expiration date without any liability whatsoever.
LÍNEA GRÁFICA, E.C.E. S.L. has a credit system through which THE CLIENT can add money to his account and always have money available. The minimum deposit is 5€ and the maximum deposit is 500€, for each time it is requested.
Once the invoice generated by requesting "Add funds" from the client area has been paid, t h e CLIENT will have the money immediately available in his/her account. Any invoice generated from that moment on, will be automatically charged from that fund.
In the statistics of the account, the CLIENT will be able to see at any time the amount that he/she has available in his/her credit/fund, specifically in the "Credit Balance". If this box appears in red and negative, you must settle the amount within a maximum period of 5 days, unless you have your payment by direct debit (See legal terms of direct debit).
THE CUSTOMER should be careful with those services that he/she does not want to renew, because if an invoice is generated, it will be paid automatically if there are funds in his/her favor, and therefore the service will be renewed, without the possibility of refund in the case of domains. The CUSTOMER can avoid this incidence by cancelling the products at least 31 days before the renewal date.
The money that THE CUSTOMER has in his account will have no time limit in use, no minimum or maximum period to be consumed is established.
In the event of cancellation of the service or product contracted by THE CUSTOMER due to breach of this contract, THE CUSTOMER shall lose all rights to its credit.
LÍNEA GRÁFICA, E.C.E. S.L. only gives commissions for purchases made using the affiliate code. LÍNEA GRÁFICA, E.C.E. S.L. offers an initial credit of 5€ when signing up as an affiliate.
The earnings of each purchase will be effective 45 days after the date of purchase of the product. In this way, if there is any return of the product, the profit will be null and void.
22.4 THE CLIENT has the right to claim his winnings only after having exceeded the minimum imposed at that time. Currently the minimum is 25 €. To do so, THE CUSTOMER must access the customer area, enter the affiliates section and click on the corresponding button to request the money. This money will be credited to the customer's account. The credit has no expiration date, it can be used whenever desired. Likewise, the CLIENT can request that the affiliate earnings be credited to his paypal account or to his bank directly.
In case there is a bank commission to make the deposit, it will be deducted from the total commission of the CLIENT.
22.4. LÍNEA GRÁFICA, E.C.E. S.L. will not give commissions for domain purchases.
If the data transfer reaches the amount contracted in the corresponding plan, LÍNEA GRÁFICA, E.C.E. S.L. will suspend the account, unless THE CUSTOMER contracts a higher plan. The account will be reactivated at the beginning of the following month.
For streaming servers in general, if the monthly transfer quota is exceeded, you will be billed separately for the exceeded portion. The amount to be charged is stipulated by the data center where the server is hosted.
Live broadcasting over the Internet is completely legal as long as you have the proper copyright authorization for the phonographic material you are transmitting over the Internet.
In Spain, copyrights are protected and managed by the SGAE. Internet broadcasting REQUIRES the proper authorization and license by the SGAE.
SGAE has established that in order to broadcast on the Internet phonographic content protected by its copyrights, it is necessary to have its license and pay the due fees.
In any case, when contracting a radio station with LÍNEA GRÁFICA, E.C.E. S.L., we will not ask whether or not THE CLIENT has authorization from the SGAE or any other copyright manager. This matter is not within our competence and is entirely the responsibility of THE CLIENT.
LÍNEA GRÁFICA, E.C.E. S.L. offers special offers and promotions throughout the year. Each promotion has its own conditions, which are set out in detail on the website.
If THE CUSTOMER makes a change that affects the conditions of the promotion or offer in force, he/she will lose the benefits of such promotion, and must pay the corresponding fee that LÍNEA GRÁFICA will charge,
E.C.E. S.L. informs you.
Normally the prices of all products are modified every year. However, LÍNEA GRÁFICA, E.C.E. S.L. maintains and respects the initial price at which the CLIENT contracted the service.
LÍNEA GRÁFICA, E.C.E. S.L. reserves the right to apply discounts on its products or services through promotions and offers.
The relationship between the parties is that of a customer and a service provider.
The CLIENT shall not have any right to bind LÍNEA GRÁFICA, E.C.E. S.L. before third parties without the express consent of LÍNEA GRÁFICA, E.C.E. S.L..
Unless o t h e r w i s e required by procedural law, the parties agree to communicate b y e-mail or mail, using the most current addresses in their possession. The parties shall be obliged to keep proof of having given notice to the other party.
THE CLIENT exonerates LÍNEA GRÁFICA, E.C.E. S.L. from any liability related to the content of the information stored by THE CLIENT on LÍNEA GRÁFICA, E.C.E. S.L. servers.
The CLIENT is solely responsible for any claim or legal action, judicial or extrajudicial, initiated by third parties against both the CLIENT and LÍNEA GRÁFICA, E.C.E. S.L., based on the content of such information, and the CLIENT shall assume all expenses, costs and indemnities incurred by LÍNEA GRÁFICA, E.C.E. S.L. as a result of such claims or legal actions.
Any user who deposits information on the servers of LÍNEA GRÁFICA, E.C.E. S.L., in the form of web pages, or in any other way, which allows access by third parties, shall not become, by virtue of such act, a partner or collaborator of LÍNEA GRÁFICA, E.C.E. S.L., but shall be a discloser or independent publisher of content. S.L., but shall be an independent publisher or publisher of content. By connecting a server to the network, LÍNEA GRÁFICA, E.C.E. S.L.. Resources beyond the control of LÍNEA GRÁFICA, E.C.E. S.L. are also considered, among others, the following: programs, texts and user data; unmoderated newsgroups from the server itself; newsgroups from other servers; chats; distribution lists; FTP and Telnet accounts.
In order to prevent infractions in which LÍNEA GRÁFICA, E.C.E. S.L. could be found guilty of
In order for the CLIENT to be held liable, the CLIENT expressly authorizes LÍNEA GRÁFICA, E.C.E. S.L. to carry out the necessary control measures to verify the legality of the information deposited on the server under its administration. The CLIENT also authorizes LÍNEA GRÁFICA, E.C.E. S.L. to provide the data required by the State security forces by court order, in the course of a police investigation.
LÍNEA GRÁFICA, E.C.E. S.L. undertakes to make every effort to maintain an acceptable level of compliance with its contractual obligations, but cannot guarantee, explicitly or implicitly, the continuity of service at any given time, nor the integrity of the information stored or transferred through its system or the Internet. LÍNEA GRÁFICA, E.C.E. S.L. is also not responsible for unauthorized access by third parties to CUSTOMER information stored in the system, loss or corruption of the same.
LÍNEA GRÁFICA, E.C.E. S.L. shall not be liable to THE CLIENT, nor to its clients, for any damages resulting from these cases, including: total or partial loss of information, inability to access the Internet, or inability to transmit or receive information caused by delays or service interruptions, whether or not they are the responsibility or negligence of LÍNEA GRÁFICA, E.C.E. S.L..
The present contract shall be applicable from the date of acceptance of the same by THE CUSTOMER. The duration of this contract will depend on the period specified for each type of service, which will be chosen by the CUSTOMER at the time of purchase.
This contract is tacitly renewed if the parties continue to comply with their contractual obligations. Therefore, upon termination of this contract, without either party having given the other party at least 10 days' notice of termination, this contract shall be tacitly renewed for a period equal to that corresponding to the service chosen.
However, LÍNEA GRÁFICA, E.C.E. S.L. may immediately terminate this contract in the cases contemplated in the clauses of the contract. LÍNEA GRÁFICA, E.C.E. S.L. may exercise this right without prior notice and THE CLIENT shall not be entitled to claim any compensation.
The rights and obligations of THE CLIENT may not be subrogated by third parties without the written consent of LÍNEA GRÁFICA, E.C.E. S.L., which undertakes to give reasons in case of non-acceptance.
LÍNEA GRÁFICA, E.C.E. S.L. reserves the right to modify this contract in order to update its content. The CLIENT may view the updated contract at any time in the section BASE OF KNOWLEDGE - LEGAL INFORMATION - LÍNEA GRÁFICA, E.C.E. S.L. CONTRACT, within the website.
It shall be understood that THE CLIENT accepts the modifications if he/she continues to use the services of LÍNEA GRÁFICA, E.C.E. S.L. after the modification date.
The contract will automatically terminate when the CUSTOMER voluntarily allows the product to expire. In the case of customers who have contracted the direct debit service, the contract will not terminate automatically. In this case, the CLIENT must notify LÍNEA GRÁFICA, E.C.E. S.L. to terminate the service and the corresponding contract. For more information, please refer to the terms and conditions
legal requirements for direct debit.
The present contract may be terminated by the unilateral denunciation of either party, with a written and reliable notice of 30 days.
The exercise of this power shall not give rise to or entitle any of the parties to demand compensation for damages, except for those inferred fraudulently or culpably and those which, as a consequence of the early termination, remain pending consideration.
Notwithstanding the foregoing, and in accordance with the general rules of contracting, the breach by any of the parties of the obligations contracted by law or contract shall entitle the other party to consider the contract automatically terminated without the need for prior notice, and it shall be sufficient with the reliable notification of this termination to the defaulting party, indicating the will and cause of termination.
Should any part of this contract be contrary to law and therefore invalid, this shall not affect the other provisions that are in accordance with the law. The parties undertake to renegotiate those parts of the contract that are invalid and to incorporate them into the rest of the contract.
This contract shall be governed in all respects by the laws of Spain and any dispute arising under this contract or in connection therewith, shall be to the courts and tribunals of the domicile of the user and the out-of-court dispute resolution system of CONFIANZA ONLINE (www.confianzaonline.es) as an entity attached to CONFIANZA ONLINE LÍNEA GRÁFICA, E.C.E. S.L., shall be entitled, at its sole discretion, to initiate proceedings in the courts of any other country in which the CLIENT resides or in which any of the assets of the CLIENT and / or its group companies are located.
LÍNEA GRÁFICA, E.C.E. S.L. explicitly undertakes to keep the data and information received from its users, both from the forms filled out and those generated by browsing the website, strictly confidential, using technologies that allow for maximum security of the same.
The hour packs will expire one year from the date of your contract, at which time your counter will be reset and you will need to purchase a new pack to be able to attend to pending and new task requests.
The Packs of hours service is a service designed to perform any type of development work that involves improvements, corrections and evolutions.
In no case shall it be understood as an immediate support service and the tasks shall always be performed during working hours, on non-holiday days.
The tasks requested may have a start time of up to 15 days, after the communication of such request, with no delivery commitment date, since depending on the task the execution time may be longer or shorter.
The customer may request an extension of three months, as long as it is done before the end of the year from the date of contracting.
The e-mail service that LÍNEA GRÁFICA, E.C.E. S.L. offers to its clients is governed by a series of rules and norms, which aim to achieve the following objectives:
To guarantee, at all times, a robust, fast and reliable mail service.
To protect the privacy of our customers' data to the maximum extent possible.
Avoid any type of abuse of the mail service.
All users of LÍNEA GRÁFICA, E.C.E. S.L.'s e-mail service must know and respect the general conditions of the contracted service. For the email service, which is included in the different types of web hosting, the following rules must be taken into account in order to achieve the above objectives:
It is necessary to protect the passwords associated with e-mail boxes, storing them in a safe place and preventing their disclosure to third parties. The customer must inform LÍNEA GRÁFICA,
E.C.E. S.L. in case of loss or theft of your email passwords.
Customers will be responsible for the misuse of their email accounts, either by negligence, ignorance of use or abusive use of the service.
Persons who violate the security systems of the e-mail and, in general, of any LÍNEA GRÁFICA, E.C.E.
S.L. system, may incur civil and criminal liability. may incur civil and criminal liability. Apart from those indicated in the general terms and conditions of service, the following actions are expressly prohibited for the e-mail service:
Sending illegal content, such as apology of terrorism, pirated programs, child pornography, threats, scams, pyramid schemes, viruses or hostile code in general, etc.
Massive dissemination of messages, especially unsolicited advertising. It is also forbidden to send mass mailings without the express consent of the recipients.
LÍNEA GRÁFICA, E.C.E. S.L.'s e-mail service is a tool for the exchange of information between people, not a tool for the mass dissemination of information. LÍNEA GRÁFICA,
E.C.E. S.L. has established a daily limit of shipments, which is marked as follows, according to the type of accommodation contracted:
Personal Plan: 400 emails/day
Business Plan: 600 emails/day
Advanced Plan: 900 emails / day
Superior Plan: 1200 emails /day
Dedicated and VPS servers : 1200 emails / day
Hosting Prestashop Comienza Avanza y Profesional: 1200 emails / day
If you wish to change this configuration, please contact contacto@lineagrafica.es or call 954312200. The reason for this limitation is to avoid any type of attack aimed at hindering or hampering the mail service or other services.
38.B SMS PACK SERVICE CONDITIONS.
LÍNEA GRÁFICA, E.C.E. S.L. will provide you with private access to its SMS platform located at sms.lineagrafica.es provided that the service called "PLATAFORMA SMS" is contracted and paid for, which is associated with an initial purchase of SMS PACKS.
The SMS rate will be 0.055€ per SMS when buying a pack of less than 5000 SMS. The 5000 SMS pack has a rate of 0.05€ per SMS.
LÍNEA GRÁFICA, E.C.E. S.L. undertakes to provide the Client with the service for the preparation and sending of mass messaging campaigns, the organization of contact lists and the consultation of statistics. All this within the sms.lineagrafica.es platform.
OBLIGATIONS:
The Client agrees to use the Service(s) of LÍNEA GRÁFICA, E.C.E. S.L. in accordance with the legal and regulatory provisions, with special but not exclusive respect for the rules governing the issue of spam and privacy.
The Client is solely responsible for the content of the SMS messages sent to third parties, over which LÍNEA GRÁFICA, E.C.E. S.L. will not carry out any type of control or follow-up, either before or after the sending of the messages.

In order to use the Services provided by LÍNEA GRÁFICA, E.C.E. S.L., the Client agrees to use equipment and accessories that are in perfect working order and for which he/she is solely responsible.
RESPONSIBILITIES:
The Client indemnifies and expressly exempts LÍNEA GRÁFICA, E.C.E. S.L. from any liability associated with the content of SMS messages sent from the account and/or on behalf of the Client.
The Client further indemnifies and exempts LÍNEA GRÁFICA, E.C.E. S.L. from any liability associated with the use or publication of the shared or reserved number assigned to the Client for the SMS message reception service.
The Client expressly exempts LÍNEA GRÁFICA, E.C.E. S.L. from liability for any claims filed by third parties and/or by the Client itself in relation to the procedure for retrieval, archiving, conservation, access, distribution and destruction of the numbers used, by way of non-limiting example when it comes to the compliance of such activities with the legal and regulatory provisions in force, including those related to privacy.
With the liability of LÍNEA GRÁFICA, E.C.E. S.L. in cases of willful misconduct or gross negligence, the Client indemnifies and holds LÍNEA GRÁFICA, E.C.E. S.L. harmless from any liability associated with the failed or late sending and/or failed or late receipt of SMS, and, by way of example not
The following cases are limiting:
cases of force majeure
cases that are de facto dependent on third parties, such as interruption or malfunctioning of services telecommunications, electricity supply, signal coverage, etc..;
cases that depend on the improper and incorrect use of the equipment used by the Client, necessary for the complete and correct use of the services provided by LÍNEA GRÁFICA, E.C.E. S.L.
cases that depend de facto on the same Client or on one of its collaborators or associates;
cases that depend on the suspension or interruption of the systems in use by LÍNEA GRÁFICA, E.C.E.
S.L. S.L., even when this occurs by order of the competent authorities.
SMS SERVICE FEATURES
The Parties expressly agree that when telephone operators restrict or suspend the possibility of personalizing the sender of SMS messages, LÍNEA GRÁFICA, E.C.E. S.L. shall no longer be obliged to guarantee such service.
LÍNEA GRÁFICA, E.C.E. S.L. does not guarantee the delivery of any SMS messages unless the SIM card is activated for roaming abroad.
In the event that the Client provides inaccurate or incomplete information that makes it impossible or difficult for LÍNEA GRÁFICA, E.C.E. S.L. to provide the service(s), LÍNEA GRÁFICA, E.C.E. S.L. reserves the right not to activate and/or suspend the Service(s) until the Client has taken the necessary steps to remedy the situation. LÍNEA GRÁFICA, E.C.E. When, for reasons attributable to the telephone operators, one or more telephone numbers used for the SMS Online Service are deactivated and/or suspended, LÍNEA GRÁFICA, E.C.E. S.L. undertakes to request new numbers from the same telephone operators, in order to maintain the same quantitative and qualitative level of service.
The Customer undertakes here and now not to claim any price reduction and/or compensation for damages caused by a change of numbering.
38.C PRESTASHOP MODULES CONDITIONS
LÍNEA GRÁFICA, E.C.E. S.L. offers its customers, the sale of modules for Prestashop Stores in different versions that will be informed in the product sheet of each module that is for sale.
Because Prestashop is an Open Source platform and any holder or owner of a Prestashop online store can access the code of the same, can make modifications, have undetected vulnerabilities, not having a proper maintenance or hosting and other types of situations, LÍNEA GRÁFICA, E.C.E. S.L. does not guarantee nor is responsible for the impact of any kind involving the installation and use of its modules marketed. However, all modules that are marketed have technical support and updates (if any) for a limited time, which may or may not be renewed based on the policies of the company in this regard.
In case of detecting code modifications on the contracted module/s requesting support, we reserve the right not to provide the service.
LÍNEA GRÁFICA, E.C.E. S.L. always recommends, before installing any module in a Prestashop online store, to make or have a recent and complete backup of it.
LÍNEA GRÁFICA, E.C.E. S.L. will only support the domain that is reflected in the module file contracted by the client, who informs it during the purchase process and can modify it up to 2 times by requesting a ticket to the technical support or administration department.
LÍNEA GRÁFICA, E.C.E. S.L. reserves the right to modify the conditions of sale, support service and updates of prestashop modules for sale and sold at any time.
All modules developed by LÍNEA GRÁFICA, E.C.E. S.L. are intellectual property of LÍNEA GRÁFICA,
E.C.E. S.L., and therefore reserves the right to encrypt part or all of the code of the same, as well as licensing the marketing by technological means that will be informed to the customer.
38.D CONDITIONS OF SERVICE FOR ONLINE STORES SYNCHRONIZED WITH TECH DATA ESPAÑA S.L.U.
This service contracted by the CLIENT consists in the hiring of an online store, which is offered in different contracting modalities, based on Prestashop technology with the following characteristics and restrictions:
The online store that the customer leases is based on Prestashop 1.7 technology.
The online store is intended for Tech Data España, S.L.U. customers only.
The online store is equipped with an automatic synchronization system that checks with Tech Data España, S.L.U. systems the stock when accessing a product file and when it is added to the shopping cart.
The store catalog is automatically acquired from Tech Data Spain's systems,
S.L.U. enables for each of its customers who contract this service.
The store will allow you to indicate the price range at which you want to sell the products, segmented by families and subfamilies.
The store is prepared so that when an order is received by an end customer (of Tech Data products, and the customer makes the payment), it automatically connects with Tech Data, sends the information, and it sends the order to the end customer (Dropshipping process).
The store will allow adding new products only on an individual basis. Any possibility of mass import has been restricted.
When an order is produced with Tech Data products and products uploaded by the customer, it will be split into 2 orders and only the order with the products that are associated with them will be sent to Tech Data and the rest will have to be processed manually by the online store administrator.
